The petitioner has filed this petition praying for following relief:- “It is, therefore, prayed that this Hon'ble Court may kindly be pleased to allow this petition and quash PØRO No 495/2014 for commission of forest offence under section 2(14), (20), (36), (37), 09, 39, 43, 44, 48, 49, 50/51 (1) proviso and section 52 of Wild life (protection) act 1972 as submitted by the Forest Range officer Maddedh Buffer and thereby also quash of the cognizance taken by the learned Chief Judicial Magistrate Bijapur and pendency of the proceeding of Criminal Case No 362/2023 for framing of the charge, in the interest of justice.” 4. On a pointed query being made to the learned counsel for the petitioner as to why he has not challenged the order taking cognizance, he could not give any satisfactory answer to the same. 5. In view of the same, learned counsel for the petitioners prays to withdraw the present petition with liberty to file afresh. 6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today, and the same shall be transmitted to the Government Home for Mentally Underdeveloped Children, Mana Camp, District- Raipur (C.G.). 7.
