Heard learned counsel for the applicant, learned counsel for the complainant and learned A.G.A. for the State as well as perused the record. 3. The present anticipatory bail application has been filed by accused-applicant seeking anticipatory bail in Case Crime No.111 of 2025, under Sections 351(3), 64(1), 331(4) of BNS, P.S. Fakharpur, District Bahraich. 4. A perusal of the record shows that victim in her statement under Sections 180 & 183 BNSS has supported the prosecution case. Eye witnesses namely Sahjanha, Rihana and Taheer as well as independent witnesses Iqbal Ahmad and Mudassir have supported the prosecution case. One of the eye witnesses Taheer in his statement under Section 180 BNSS has stated that he has seen the accused going into the house of the victim. He has also seen him molesting the victim and raising alarm although victim has denied the medical examination. Perusal of the record so also the statement of the independent witnesses particularly eye witness prima facie support the prosecution case, it cannot be said that accused has been falsely implicated or has been framed only to injure his reputation, no case for anticipatory bail is made out. The anticipatory bail application is dismissed. 5. At this stage, learned counsel for the applicant prays for and is permitted to move regular bail application which, if filed, shall be decided expeditiously as per law.
