.... Petitioner(s). Versus The State of Jharkhand
… Opp. Party(s). CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. S. Choudhary, Advocate Ms. Aayush Ojha, Advocate For the State : Mr. Manoj Kr. Mishra, AddI. P.P.
…...... 03/ 20.06.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 406, 420, 467, 471, 120B of IPC. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. It is alleged that complainant was in search of land for construction of the house. Petitioner was the broker, who was working for them. They arranged some land and the seller also intend to sell the same. Thereafter, Rs.14 lakhs and odd was transferred including some money to the broker also. The complainant was constructing the boundary wall of the land, but the same was demolished by the Government officials. It is alleged that the complainant realized that the land was Government land. Again, another negotiation was entered into and another land was shown to the complainant after taking some more money, when thereafter it came to notice that the said land is recorded as pond in the register. Thereafter, it is alleged that the complainant and witnesses have approached the accused for refund of the money, but the same is not being recovered. 5. After hearing the parties, I am of the opinion that the dispute primarily is civil in nature and it relates to sale and purchase of the land for which
advance was given. It is alleged that the land is not been provided or the land which is provided did not have a prefect title. Considering the nature of allegation which primarily is a civil dispute, I feel that this is a fit case for grant of anticipatory bail of the petitioner. 6. Accordingly, this Anticipatory Bail Application stands allowed.
The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Jamshedpur, in connection with Birsanagar P.S. Case No.66 of 2021, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
