Borthakur, learned counsel for the petitioners. Also heard Mr. Page No.# 5/6 R. Borpujari, learned standing counsel for the Revenue and Disaster Management Department for respondent no. 1 and Mr. D. Nath, learned Senior Government Advocate for respondent nos. 2, 3 and 4. 2. The learned counsel for the petitioners submitted that at the present moment extensive eviction drive is being under taken by the District Administration of the Dhubri district to have the Government land cleared of encroachments for the purpose of handing it over to the APDCL for power project. Accordingly, apprehending their eviction from the Government land which the petitioners are presently occupying, the present writ petition has been filed under Article 226 of the Constitution of India. 3. The learned counsel for the petitioner has also submitted that in respect of the land being occupied by the petitioners, they have filed online applications under Mission Basundhara scheme, which is still pending for consideration. 4. The learned standing counsel for the Revenue and Disaster Management Department has submitted that he has taken telephonic instructions from the Office of the District Commissioner, Dhubri and he has received telephonic instruction to the effect that land which the petitioners are currently occupying, though Government land, is not in the vicinity of the proposed power project and therefore, for the time being there is no move by the District Administration to evict the petitioners. 5. In view of the specific telephonic instructions received by the learned standing counsel for the Revenue and Disaster Management Department that the land of the petitioners is not in the vicinity of the proposed power project and taking into consideration the law laid down in the case of Salak Uddin Vs. State of Assam & Ors.,(2024) 6 GLR 614, the Court is inclined to dispose of the Page No.# 6/6 writ petition at the motion stage by providing that in view of the procedure laid down under the Assam Land and Revenue Regulation, 1886 and Rules framed thereunder and also taking into account the decision of the Division Bench of this Court in the case of Salak Uddin (Supra), it provided that if any action for eviction is contemplated against the petitioners in respect of the Government land held by them then such action shall adherence to the procedure laid down in the Assam Land and Revenue Regulation, 1886 and rules framed thereunder, as well directions contained in the case of Salak Uddin (Supra), which includes prior notice to each of the persons who is alleged to be in unauthorized occupation of the Government land. 6. The matter is disposed of in the motion stage without issuance of notice to the respondents. 7. The petitioners shall produce a certified copy of this order before the District Commissioner, Dhubri to bring the order to the notice of the said authority and give the full description of land which they are occupying, with construction, if any, standing thereon. 8.
