2. The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest instituted under Sections 115(2)/126(2)/109/76/351(2)/351(3) & 3(5) of the B.N.S.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case and has not committed any offence as alleged in the F.I.R. It is submitted that the similarly situated co-accused person, namely Ganesh Kumar has already been granted anticipatory bail by this Court in A.B.A. No.2995 of 2025 vide
order dated 03.06.2025. It has further been submitted that petitioner has no criminal. He lastly submits that he has been falsely implicated in this case due to village rivalry.
4. Learned A.P.P. opposed the prayer for bail.
5. Having regard to the facts of the case, I am inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within four weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand Only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bermo at Tenughat in connection with Bermo P.S. Case No.36/2025 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhaar Card with an undertaking that he will not change his mobile number during the pendency of the case and subject to the conditions as laid down under

Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is made clear that if the petitioner does not cooperate with the investigation/trial, the State would be at liberty to take appropriate action. (Deepak Roshan, J.) Sandeep/Rahul
