Heard learned counsel for the parties. 2. The petitioner is apprehending his arrest in connection with Chas (M) P.S. Case No. 34/2025 for the offences registered under Sections 303(2), 317(2) of the Bharatiya Nyaya Sanhita, 2023 and u/s 21 of M.M.D.R. Act 1957, Rule 54 of JMMC Rules, 2004 and Rule 13 of Jharkhand Minerals (Prevention of illegal Mining, Transportation and Storage) Rules, 2017. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that there is no direct allegation against the petitioner and petitioner has no criminal antecedent, as such he may be given the privilege of anticipatory bail. 4. Learned A.P.P. opposed the prayer for anticipatory bail. 5. Having regard to the facts of the case and looking to the allegations made against this petitioner, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is directed to surrender before the court below within a period of four weeks from today and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Bokaro in connection with Chas (M) P.S. Case No. 34/2025, subject to the conditions as laid down under Section 482(2) of BNSS, 2023. 6. It is made clear that if the petitioner will not cooperate in investigation/trial, the State would be at liberty to take appropriate action. (Deepak Roshan, J.) Pawan/Sangam/ -
