1. None appears nor any representation is made on behalf of the applicant to press this bail application when the case is called out. 2. This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 585/2024 registered at Police Station – Ratanpur District – Bilaspur, (C.G.), for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. The prosecution story, in brief, is that on 13.09.2024, the police of Police Station Ratanpur, District Bilaspur (C.G.), received secret RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN

Based on the information provided by the secret informant, the police intercepted a white Maruti Suzuki Swift Dzire car bearing registration No. HR-51 AM-8554 at Village Lalpur near Bangali Resort. Upon searching the said vehicle, 101.700 kilograms of the psychotropic substance Ganja was recovered from its trunk. The driver of the vehicle disclosed his name as Rajesh Sharma. He was taken into custody, and based on his memorandum statement, other co-accused persons, including the present applicant, were found to be involved in the case. Consequently, the police of Police Station Ratanpur, District Bilaspur (C.G.), registered FIR bearing Crime No. 585/2024 for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, against the present applicant and other co-accused persons. 4. Learned State counsel submits that the charge-sheet has been filed in the present case before the competent Court. She further submits that the quantity of contraband article i.e. total 101.700 kilograms of the psychotropic substance Ganja was seized from the possession of the co-accused Rajesh Sharma, and based on his memorandum statement, other co-accused persons, including the present applicant were implicated.
However, the applicant actively participated in the crime and involved in carrying the said contraband article, which is much above the commercial quantity, his involvement in this organized crime is evident, as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the State and perused the case- diary. 3

Considering the facts and circumstances of the case and further the fact that the quantity of contraband article i.e. total 101.700 kilograms of the psychotropic substance Ganja was seized from the possession of the co-accused Rajesh Sharma, and based on his memorandum statement, other co-accused persons, including the present applicant were implicated, however, the applicant actively participated in the crime and involved in carrying the said contraband article, which is much above the commercial quantity, his involvement in this organized crime is evident and the applicant has failed to give any explanation for the same, further it cannot be a case of false implication. 7. Accordingly, the bail application of the applicant – Bikram Patra, involved in Crime No. 585/2024 registered at Police Station – Ratanpur District – Bilaspur, (C.G.), for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
