Heard learned counsel for petitioner, learned State Counsel for opposite parties 1, 4 and 5 and Mr. Ashutosh Shahi learned counsel for opposite parties 2,3 and 6. 2. Petition has been filed challenging order dated 30th November, 2024 whereby the grade pay earlier made to petitioner has been reduced. 3. As per submissions of learned counsel for petitioner and even upon perusal of impugned order, it is evident that the aspect under consideration pertained to one late Vijay Kumar Gupta but by means of impugned order, petitioner's grade pay has also been reduced. It is also discernible that the impugned order has been passed without issuing any show cause notice to petitioner or even affording any opportunity of hearing. Ex facie the order has been passed on an ex parte basis. 4. In view of aforesaid, the impugned order dated 30th November, 2024 is hereby quashed by issuance of writ in the nature of Certiorari granting liberty to opposite parties to pass fresh order but only after affording opportunity of hearing to petitioner. The petitioner therefore be entitled for the salary which he was being paid prior to passing of the impugned order which shall continue till passing of fresh orders by the order passed and shall abide by the same. 5. In view thereof, the petition stands allowed at the admission stage itself. Parties to bear their own cost.
