Mahto, APP ------ Order No. 03 / Dated : 05.06.2025. Heard learned counsel for the parties. 2. The petitioner is apprehending his arrest in connection with Simariya P.S. Case No. 51/2025 for the offences registered under Sections 89, 91, 125, 221, 289, 318(2), 319(2), 338, 341(1), 336(3) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 41 of Clinical Establishment (Registration and Regulation Act). 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the petitioner is an employee and not a proprietor of Sanjeevani Hospital, Simariya and used to do office works only. He lastly submits that the petitioner has no criminal antecedent. 4. Learned A.P.P. opposed the prayer for anticipatory bail. 5. Having regard to the facts of the case and looking to the allegation made against this petitioner, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is directed to surrender before the court below within a period of four weeks from today and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Simariya P.S. Case No. 51/2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 6. It is made clear that the petitioner shall cooperate in the investigation/trial and if the petitioner will not cooperate in the investigation/trial, the State would be at liberty to take appropriate action.
