1. Heard Mr. J. Abbas, learned counsel for the petitioners. Also heard Mr. R. R. Kaushik, learned Additional Public Prosecutor.
2. This petition under Section 482 BNSS is filed by the petitioners, namely, Dipen Baruah and Dharmendra Baruah, apprehending arrest in connection with Bongaigaon P.S. Case No.34/2025 under Sections 61(2)/318(4)/316(2)/351(2) of the BNS Act.
3. The case arose out of an ejahar dated 05.02.2025 which reflects about purchase of land from one Rabin Baruah for Rs. 14 lakhs and subsequently, came to know that the accused persons named in the FIR have no land to sale and several suits were pending against the said land and that they were actually land brokers who had cheated other persons. It is further submitted that the said Robin Baruah has been arrested.
4. It is submitted by the learned counsel for the petitioner that pursuant to grant of interim bail, the petitioner has appeared before the IO and co-operated with the investigation and prays that their interim bail should be made absolute.
5. Case diary has been received.
6. Learned Additional Public Prosecutor opposing the bail petition submits that investigation found adverse material against all the named accused persons including the present petitioner and the accused persons are involved in such modus operadi.
7. Accordingly, the pre-arrest bail application stands rejected thereby vacating the interim order.
