GUNESHWAR SHARMA ORDER 08.07.2025 [1] Present Ms. Malemleima, learned counsel for the petitioner, Mr. N. Gautam, learned counsel for the National Institute of Technology (NIT) and Mr. B. Kirankumar, learned counsel for the respondent no. 4. [2] By the present writ petition, the petitioner has challenged the appointment of respondent no. 4 as Assistant Professor (Chemistry) in NIT, Takyelpat, Imphal, vide appointment letter dated 02.12.2013. [3] The learned counsel for the respondent no. 4 draws the attention of this Court to the additional affidavit dated 25.08.2020 filed by respondent no. 4 wherein, it has been stated that during the pendency of the present writ petition, the respondent no. 4 has been appointed as Associate Professor (Chemistry) on direct recruitment vide appointment letter dated 11.09.2018. Hence, after appointment of the respondent no. 4 as Associate Professor (Chemistry) on direct recruitment, the cause of the writ petition has become infructuous and the writ petition may be closed. [4] The learned counsel for the petitioner submits that the prayer no. 3 of the present petition as to hold review of the DPC is still survived and the case of the petitioner may be considered on the seat vacated by the respondent no. 4. [6] This Court has considered the material on records and appointment of respondent no. 4 as Associate Professor (Chemistry) in NIT, Imphal, vide appointment letter dated 11.09.2018. [7] The present writ petition is disposed of with directions to the NIT, Takyelpat, Imphal to consider the case of the petitioner as to whether he is eligible for appointment in the place of Assistant Professor (Chemistry) in vacant seat and shall be completed within a period of 3(three) months from the date of receipt of a copy of this order. [8] With these observations, the present W.P. (C) No. 431 of 2014 is disposed of. [9] Registry is directed to return the proceedings of the DPC/Selection Committee, if the same is available on record. JUDGE Thoiba
