The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 140/2025, registered at Police Station – Janjgir, District – Janjgir-Champa(C.G.) for the alleged commission of offence punishable under Sections 318(4), 61(2) B.N.S. 66(C) of IT Act and 42(3)(E) of the Indian Telecommunication Act. 2. The case diary was perused in the context of the above application which shows that the applicant has committed offence punishable under Sections VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.04.05 20:07:25 +0530 2 318(4), 61(2) of BNS, 66© of I.T. Act and 42(2)(E) of Indian Telecommunication Act. That the co-accused Kishore Ramwani, operator of Fun Mobile shop situated at village Naila, police station – Janjgir, District – janjgir-Champa obtained 30 SIM customers without informing them with the intention of hiding the identity of the real used through their identity documents and photo and distributed them to different persons. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He has not committed any crime. Co-accused, namely, Ku. Ankita Gupta has been granted bail by this Court vide order dated 17.03.2025, passed in MCRC-2085-2025. Therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant and submits that he is not entitled for grant of anticipatory bail, as 03 other cases for the similar offence have also been registered against the applicant and so far as Co-accused, namely, Ku. Ankita Gupta is concerned she has been granted regular bail by this Court. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence and material on record in the case diary and also considering the fact that the 03 other cases for the similar offence have also been registered against the applicant and co-accused, Ku. Ankita Gupta have been granted regular bail by this Court, therefore, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant– Abhinav Mittal filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No. 140/2025, registered at Police Station–Janjgir, District – Janjgir-Champa (C.G.) for the alleged commission of offence punishable 3 under Sections 318(4), 61(2) BNS, 66(C) of the Indian Telecommunication Act, is rejected.
