The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 385/387/34 of IPC, Sections 25(1-b)a, 26, 35 of the Arms Act and Section 17 of the C.L.A. Act 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the confessional statement made by the co-accused namely Rajesh Singh, who has already been granted bail by the Co-ordinate Bench of this Court in B.A. No. 346 of 2024 vide order dated 27.02.2024. Further submission has been made that no incriminating material has been found from the possession of the petitioner. The petitioner is having no criminal antecedent and he has been languishing in custody since 20.03.2025 4. Learned APP opposed the prayer for bail. 5. Having regard to the facts of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing the bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the 2025:JHHC:14641 2 satisfaction of learned Judicial Magistrate 1st Class, Garhwa in connection with Ramkanda P.S. Case No. 33 of 2023. 6. It is made clear that till commencement of trial, the petitioner shall report to the local police station every month and after commencement of trial, he shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this petitioner, the learned trial court shall be at liberty to cancel the bail of this petitioner.
