HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7469 of 2025
Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA for the State; Ms. Nivedita Gupta, learned counsel holding brief of Shri Jay Kumar Soni, learned counsel for the complainant and perused the record. 2. The applicant seeks enlargement on bail in FIR No.224 of 2025, under Section 80, 85 BNS & Section 3/4 of D.P. Act, P.S. Kotwali Nagar, District Rae Bareli. 3. The FIR in question was lodged alleging that daughter of the informant was married to the applicant around two years ago and subsequently, on account of non-payment of dowry she was done to death. The postmortem report on record indicates the cause of death as ante mortem hanging and apart from the ligature mark, no other injury was observed. 4. It is argued that the co-accused i.e. father-in-law was enlarged on bail. 5. Learned AGA has opposed the bail application. 6. Considering the postmortem report and there being nothing specific against the applicant to suggest that soon before the death, the victim was subjected to mental and physical harassment at the instance of the applicant, the applicant who is in custody since 22.05.2025 and has no criminal antecedent, is entitled to be enlarged on bail. In view thereof, the application is allowed.
