learned counsel for the applicant.

3. Present applicant – “Poonam Chaudhary, wife of late Kunwar Pal Singh,” is praying for bail in relation to FIR dated 06.10.2023 bearing FIR No. 0169 of 2023, Police Station – Cantt. District – Dehradun wherein present applicant along with her husband Kunwar Pal Singh and two others have been implicated for the offence punishable under Section 420, 467, 468, 471 IPC.

Learned counsel for the applicant argued that allegations, as alleged in the FIR, appears to be civil in nature and present applicant was languishing in jail in different criminal case and subsequently, she was bailed out, however, again on 04.11.2025, present applicant was taken on remand in the present case and sent to jail in relation to present FIR.

He further argued that during investigation, two other accused persons namely – Manoj Verma and Kasif Siddiqui have been exonerated and during investigation, her husband died and charge sheet has been filed only against the present applicant. He further submits that applicant is ready to honour the agreement to sell dated 06.05.2023 and by executing the sale deed in favour of the complainant, since she became absolute owner, after death of her husband, by virtue of registered gift deed.
6. Apart from this, he submits that charge sheet has already been filed on 06.08.2024, therefore, there is no need of custodial interrogation of the applicant.
7. On the other side, learned State Counsel submits that since the applicant has already given undertaking that she is ready to execute sale deed in favour of the complainant in terms of
agreement to sell, in such an eventuality, the applicant may be enlarged on bail.
8. After hearing the arguments of learned counsel for the parties and further taking into
consideration that the charge sheet has already been filed and furthermore, in paragraph 13 specific averment has been made that she is ready to execute the sale deed, this Court is of the view that the applicant deserve for bail.
9. Accordingly, without expressing any opinion on the merit of the case bail application is allowed.
10. Let the applicant “Poonam Chaudhary, wife of late Kunwar Pal Singh” be released on bail on furnishing her personal bond and two sureties, each of the like amount to the satisfaction of the court concerned.
