This is an application filed under Order XXII Rule 3 of the CPC, 1908 for substitution of the opposite party Nos. 1a, 1b & 1c as legal heirs of the deceased respondent No.1 who is the original plaintiff No.1 in the plaint. The learned counsel for the petitioner submits that during the pendency of the case, the respondent No.1 who is the original plaintiff No.1 in the plaint expired. Therefore, prays for impleading his legal heirs by substituting the respondent no.1 by opposite party nos. 1a, 1b & 1c. The prayer is allowed. Let the name of Smt. Nilima Goswami, wife of Naba Kanta Goswami be impleaded as respondent No.1a; Ms. Jugasmita Goswami, daughter of Naba Kanta Goswami, as respondent No.1b; and Mr. Sri Susanka Goswami, son of Naba Kanta Goswami as respondent No.1c in place of respondent No.1 Shri Naba Kanta Goswami, (since deceased).
