2 Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 10.09.2025 1) The petitioner has filed this petition seeking the following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the Petitioner for its kind perusal. 10.2. That, this Hon'ble Court may kindly be pleased to direct the Respondent No.2 to release the entire GPF amount after making necessary correction in computation sheet within stipulated period, in the interest of justice. 10.3 The Hon'ble Court may kindly be pleased to to direct the Respondent No.2 to decide the representation Dt. 13.04.2017 (Annexure P-1) and 17.08.2017 (Annexure P-2), within stipulated period. 10,4 That, any other relief, this Hon'ble Court deem fit and proper may also be granted to the Petitioner, in the interest of justice.” 2) Learned counsel for the petitioner would submit that the petitioner got retired from services on 31.7.2017 from the post of Internal Audit and Tax Officer, posted at Janpad Panchayat Saraipali, District Mahasamund, Chhattisgarh. He would contend that the office of the Accountant General has shown the GPF amount of the petitioner in negative. He would submit that there was no withdrawal by the petitioner from GPF account and the State has supported the claim of the petitioner. 3) On the other hand, learned counsel for respondent No.2 would oppose the submissions made by counsel for the petitioner.
He would submit that the recovery orders dated 13.4.2017 (Annexure-P/1) & 17.8.2017
3 (Annexure-P/2) regarding negative balance in GPF account of the petitioner have been issued by respondent No.2. 4) Learned counsel for the State would submit that the petitioner withdrew the amount from GPF account during his service period and therefore, the office of Accountant General assessed the said account in negative. 5) Taking into consideration the disputed question of facts, the matter is referred to the Pension Redressal Committee. The office of Advocate General is directed to supply one copy of the petition alongwith the documents to the said Committee. The said Committee shall issue notice to the petitioner and other concern respondents and thereafter, take decision strictly in accordance with law. The entire exercise shall be completed within a period of 90 days from the date of receipt of a copy of this order. 6) With the aforesaid observations, this petition is disposed of.
