JUSTICE ARUN DEV CHOUDHURY 31.07.2025 (Ashutosh Kumar, CJ) The appellant/M/s Kaziranga Enterprise, a consortium of 9(nine) partners, participated in the bid against e-Tender floated by Hindustan Petroleum Corporation Limited (HPCL) for transportation of bulk petroleum products by road from Guwahati IRD. The appellant was successful at both the stages and was granted the contract. The work order also was given to it. However, later, on finding that the NOCs with respect to 4(four) of the Tank Trucks submitted by the appellant, was not issued by the concerned OIL Company, the respondent/HPCL thought it fit to cancel the agreement and the work order. The termination order was challenged before the learned Single Judge, who is still in seisin of the matter. Page No.# 3/3 Notices have been issued in that case and the same is to be listed for final hearing. The present appeal has been filed for the reason that the learned Single Judge did not grant any interim reprieve, allowing the appellant to continue with the operation till the time the matter is finally decided by the learned Single Judge. After some argument, Mr. K.N. Choudhury, learned Senior Advocate for the appellant seeks permission to withdraw this appeal with the liberty to approach the learned Single Judge and seek an early hearing of the writ petition.
