Heard learned counsel for the applicant and learned counsel for opposite party. 2. Present review application has been filed seeking review of the judgment dated 08.07.2025 passed in SCC Revision No.9 of 2023. 3. While filing the review application, various grounds were raised, however, subsequently both the parties agree that the judgment dated 08.07.2025 be reviewed to the extent that the same awards damages at an excessive amount. 4. Both the parties agree that total arrears of rent and damages awarded by JSCC may be quantified to Rs.5,00,000/- (Five Lac Rupees) which shall be paid by the applicant/revisionist. 5. In addition to the same, the applicant shall vacate the premises within a period of one month from today and will handover the vacant and physical possession to the opposite party. 6. In view thereof, judgment dated 08.07.2025 is reviewed to the extent that arrears of rent and damages to which the opposite party would be entitled are quantified at Rs.5,00,000/- (Five Lac Rupees) which shall be paid within a period of three months from today failing which it would attract interest at the rate of 8% per annum till payment/realization. 7. In addition to the same, non payment of the amount would be inferred as contempt of this Court. 8. The applicant/revisionist shall also vacate and handover the vacant and physical possession of the shop in question to the opposite party and to no one else on or before 15.09.2025. 9. In the event of failure to comply with any of the conditions, benefit of this order shall come to an end. 10. The amount already deposited before the trial Court alongwith cost shall be permitted to be withdrawn by the opposite party. 11. Present review application stands allowed in above terms.
