Also heard Mr. K Baishya, the learned Additional Public Prosecutor for the State of Assam. 2. This is a second bail application under Section 483 of the BNSS, 2023 in respect of Silapathar PS Case No.123/2025. Page No.# 2/2 3. On 1st June, 2025, at midnight, the informant had stopped at the place of occurrence for having tea in a shop. Some persons attacked him with sharp weapons and also showed him pistol. The informant was beaten up. Even his friends were also beaten up. Ultimately, the informant had to transfer an amount of ₹60,000/- through the account of one of the miscreants. 4. The earlier bail applications were rejected on the ground that there were some incriminating materials against the petitioners. 5. Today, Mr. Alam has submitted that the petitioner Sayed Tanfiz Ahmed had already spent 54 days in judicial custody and the period of detention already undergone should be taken as a ground for releasing the petitioner on bail. 6. Mr. Baishya has objected to the said prayer. 7. I have considered the submissions made by the learned counsel of both side. 8. This Court is of the opinion that the period of detention already undergone by the present petitioner deserves to be taken up as a ground for releasing him on bail under the given circumstances. 9. The petitioner Sayed Tanfiz Ahmed shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhemaji.
