Neutral Citation No. - 2025:AHC-LKO:46021 Court No. - 8 Case :- WRIT - A No. - 8866 of 2025 Petitioner :- All India Obc Railway Employees Association Thru. General Secy. Mr. Ashok Kumar Yadav And Another Respondent :- Union Of India Railway Board Ministry Of Railways Thru. Chairman, H.Q. New Delhi And 4 Others Counsel for Petitioner :- Kartikay Singh,Vijay Kumar Counsel for Respondent :- A.S.G.I. Hon'ble Manish Mathur,J. 1. Heard learned counsel for petitioners and Mr S.B.Pandey, learned Deputy Solicitor General of India, assisted by Mr Varun Pandey, learned counsel for opposite parties. 2. Petition has been filed seeking a direction to authority concerned to decide petitioner's representation dated 15.07.2025 in pursuance of liberty granted by this Court earlier vide order dated 10.07.2025 in Writ-A No.5812 of 2025. Further prayer for directing opposite parties to stop working of newly elected office bearers has already been sought. 3. Learned counsel for opposite parties submits that earlier as well petitioners had filed aforesaid writ petition which was dismissed as withdrawn granting liberty to petitioners to approach authority concerned for redressal of their grievances pertaining to election of office bearers of Union and in terms thereof, petitioners' association has already filed representation dated 15th July, 2025, which is yet pending consideration. 4. Upon consideration of submissions advanced by learned counsel for parties and perusal of material on record, it appears that petitioners are involved in a private dispute with regard to newly elected office bearers of the Union. This Court earlier as well in its order dated 10th July, 2025 passed in Writ-A No.5812 of 2025 has clearly indicated the aspect that it is a private dispute in which writ petition is not maintainable. Despite such an observation being made, the present petition has again been filed. 5. Learned counsel for petitioner has not been able to indicate as to how the dispute between members of a private Union which is admittedly a society would come within the purview of Article 12 and therefore within a purview Article 226 of Constitution of India. 6. In view of aforesaid, the writ petition fails and is dismissed at the admission stage itself. Parties to bear their own costs.
