By means of the instant petition, the petitioner seeks expeditious disposal of Will deed bearing Regular Suit No. 1416 of 2021 pending before the Civil Judge(Junior Division), Haveli, Faizabad now Ayodhya. It is urged that despite several dates having been fixed, the defendant has not put in appearance and the matter is still pending. Having considered the aforesaid submission and also from perusal of the extract of the order-sheet which have been brought on record as annexure no. A-2, it would reveal that perhaps the service is not complete for which the defendant is not appearing. Be that as it may, the mere fact that the suit is of the year 2021 and merely since the defendant is not appearing, this Court is not inclined to expedite the proceeding, however leaving it open for the petitioner to move an appropriate application before the court concerned which needless to say shall be considered and decided in accordance with law.
