Heard the counsel for the petitioner and the learned Standing Counsel. 2. The present petition has been filed seeking the following mandamus : "Direct the Additional District Magistrate, City Trans Gomti, Division and District Lucknow to decide the recall application dated 13-02-2025 bearing Case No. D202510460000676; Dr. Khurram Ateeq Rehmani Vs. Sumit Agarwal at the earliest within time stipulated by the Hon'ble Court in the interest of justice." 3. Considering the fact that admittedly the petitioner does not appear to have paid the rent and is trying to seek recall and the material on record demonstrates that the petitioner had put in appearance in the year 2022 and thereafter stopped appearing and has also not paid the rent, clearly the tactics of the petitioner tenant are to prolong the litigation. 4. It is provided that the order recall application shall be considered only after the petitioner deposits the entire amount of rent due till date, otherwise, the application shall be dismissed for want of payment of rent. If the petitioner deposits the outstanding rent as agreed in between the parties till 31.08.2025, the recall application will be heard and disposed of within a period of one month. In case the amounts are not paid, the recall application will be rejected. 5. With the said observations, the writ petition stands disposed off.
