Heard learned counsel for petitioner and learned State Counsel for opposite parties. Petition has been filed seeking following prayer:- " (i) issue a writ, order or direction in the nature of mandamus commanding the opposite party no. 3 and 4 to issue appointment /engagement letter in respect of any of the six vacant posts of Aaganbari Karyakarti in village-Motipur, Block-Mihipurwa, District-Bahraich on the basis of the fact that the petitioner occupies the first place in qualitative merit considering the fact that the candidate placed above the petitioner stands disqualified as her application form has been found to be incomplete during counseling, in the interest of justice." Learned State Counsel has been provided written instructions dated 2nd August, 2025, a copy of which is taken on record and as per which no final decision has been taken with regard to appointment for the aforesaid centres since there was no EWS category candidate available and the selection process has been kept in abeyance till directions are issued by the appropriate authorities. Learned counsel for petitioner however submits that aforesaid resolution is incorrect since petitioner herself had applied for the aforesaid centres under the EWS category. Since petitioner's grievances would require consideration of factual aspects, liberty is granted to petitioner to make a fresh representation before opposite party No.3 i.e. District Programme Officer, District Bahraich. In case such a representation is filed, the same is required to be decided within a period of six weeks from the date a certified copy of this order is produced before the said authority.
