Neutral Citation No. - 2025:AHC-LKO:48083 Court No. - 12 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 997 of 2025 Applicant :- Smt. Urmila Dev @ Smt. Urmila Devi And 2 Others Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. U.P. Lko. And Another Counsel for Applicant :- Amit Kumar Awasthi Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present anticipatory bail application has been filed seeking anticipatory bail in case crime No. 180/2025, U/s- 85/80(2) B.N.S & 34 D.P.Act, P.S Shardanagar, District- Kheri. Heard learned counsel for the applicant and learned A.G.A. for the State. As per the prosecution case, it is alleged that the informant’s sister was married to Sandeep Kumar about seven months ago in accordance with Hindu rites and rituals. Although dowry was given as per the informant’s capacity, the in-laws/accused persons were not satisfied and allegedly subjected the deceased to physical and mental cruelty in connection with further dowry demands.
Learned counsel for the applicants submits that they are the mother-in-law, father-in-law, and unmarried sister-in-law of the deceased. It is argued that the allegations are general in nature, the applicants have been falsely implicated, the cause of death is asphyxia due to antemortem hanging, and that the applicants are innocent and have no criminal antecedents.
Learned counsel for the applicant further submits that if the accused is granted anticipatory bail, he undertakes to comply with all conditions imposed by the Court. He shall fully
cooperate with the investigation and shall not misuse the liberty granted to him. Learned AGA has opposed the bail application, submitting that the deceased died within seven months of her marriage. Having considered the fact that the deceased died within seven years of marriage, in the matrimonial home, under unnatural circumstances; the seriousness of the offence; and the ongoing investigation, this Court finds no ground to presume false implication or that the applicants have been implicated merely to tarnish their reputation. Accordingly, no case for anticipatory bail is made out. The bail application is dismissed.
