Neutral Citation No. - 2025:AHC-LKO:45765-DB Court No. - 1 Case :- WRIT - C No. - 7574 of 2025 Petitioner :- Sheshnath Jaiswal Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko. And 2 Others Counsel for Petitioner :- Ajeet Kumar,Varunesh Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J.
1. The petitioner has filed this petition with the following main prayers:-
" Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to issue:- (1) A writ, order or direction in the nature of mandamus commanding Opposite Party No. 2 & 3 to issue a writ of Mandamus directing the a Respondents to initiate fresh and transparent recruitment process for the said post in accordance with law, petitioners, in the interest of justice. (II) A writ, order or direction in the nature of mandamus commanding Opposite Party No. 2 to decide Application dated 22.04.2025 moved by Petitioners, within specified time after affording due opportunity of hearing to all concern by speaking and reasoned order as contained in Annexure No.4 to this writ petition, in the interest of justice."
2. On being asked as to the credentials of the petitioner,
learned counsel has submitted that he is an R.T.I activist, whatever it means. It is an admitted fact that the petitioner had not applied for the recruitment which he wants to be conducted afresh.
3. We fail to understand as to how such a writ petition could be filed by him. It is not a public Interest Litigation. This is nothing but an abuse of the process of law. As regards relief no. 2, if some complaint has been made as per law, then the Lokayukta or the Uplokayukta, if it is maintainable, would obviously proceed with it, no direction of the court is required.
4. Accordingly, the writ petition is disposed of. (Manish Kumar, J.) (Rajan Roy, J.)
