Heard learned counsel for petitioner and learned State counsel for opposite parties. 2. The present petition has been filed seeking a direction to concerned authority to open the seal cover procedure adopted with regard to petitioner for the Departmental Promotion Committee held in August, 2023 for promotion to the post of Chief Development Officer/Joint Development Commissioner since at that time a departmental inquiry was pending against petitioner in which he has been exonerated. 3. Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to file a fresh representation before opposite party No.1 i.e. Additional Chief Secretary, Department of Rural Development, Government of U.P. Civil Secretariat, Lucknow or any other competent authority. In case such a representation is filed, the same shall be decided within period of six weeks from the date a certified copy of this order is produced before the said authority. 4.
