Neutral Citation No. - 2025:AHC-LKO:48731 Court No. - 4 Case :- WRIT - A No. - 8748 of 2025 Petitioner :- Santosh Kumar Ojha And 15 Others Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Energy Lko And 5 Others Counsel for Petitioner :- Sandeep Kumar Ojha,Dilip Kumar Verma Counsel for Respondent :- C.S.C.,Ran Vijay Singh Hon'ble Abdul Moin,J. Heard learned counsel for the petitioners, learned Standing counsel appearing on behalf of the respondent no. 1 and Sri Ran Vijay Singh, learned counsel for the respondents no. 2 to 5. No notice need be issued to the respondent no. 6 taking into
consideration the nature of order proposed to be passed. With the consent of learned counsel for the parties, the instant writ petition is being finally decided. The grievance of the petitioners is that they have been working on outsourced basis since more than a decade. Services of the petitioners have been dispensed with by the new service provider. Reliance has been placed on an order dated 06.02.2025, a copy of which is annexure 1 to the writ petition issued by the respondent no. 3 to indicate that the said order specifically indicates that even when a new service provider is engaged, the outsourced employees who are working earlier should be continued by the new service provider and in case it is not possible to continue them then a list of such employees should be provided to the Managing Director. Contention is that as the petitioners have been continuing since more than a decade and their working as a outsourced employees is also satisfactory consequently, there cannot be any occasion for the new service provider to have dispensed with
their services.
Learned counsel for the petitioners states that in this regard the petitioners may be permitted to bring these facts to the knowledge of the respondent no. 4 so that he may comply with the order which has been issued by the respondent no. 3 dated
06.02.2025.
Learned counsel for the petitioners after arguing at some length submits that with regard to the relief sought in the writ petition, the petitioner may be permitted to submit a representation before the respondent No.4 which may be directed to be decided within a fixed time frame to which learned Standing counsel appearing on behalf of the respondent no. 1 and Sri Ran Vijay Singh, learned counsel for the respondents no. 2 to 5 have no objection. In view of the above, it is provided that in case the petitioner submits a representation within ten days from today before the respondent No.4 then the respondent No.4 shall endevour to decide the same by means of a reasoned and speaking order within a period of four weeks from the date of receipt of a certified copy of this order along with representation. With the aforesaid direction, writ petition is disposed of.
