The instant application has been preferred for the following main relief:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the impugned summoning order dated 04.10.2024 passed by the Learned Additional Chief Judicial Magistrate, Court No.17, Sultanpur, in Criminal Case No.3081 of 2022 (Ramyagya Dubey vs. Kanchan Tiwari & others), arising out of Case Crime No.245/2016, Police Station- Kotwali Musafirkhana, District- Amethi, under Section 417 of the Indian Penal Code, contained as Annexure no.1, in the interest of justice." 3. After arguing the matter at some length, Ms. Arti Shukla, learned counsel for the applicants prays for withdrawal of this application with liberty to the applicants to file a fresh application with proper pleadings and documents in support thereof. 4. The aforesaid prayer has not been opposed. 5. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for. 6. The certified copy of the impugned order or any other certified document filed along with the application shall be returned to the learned counsel for the applicants after retaining a photocopy of the same on record.
