Neutral Citation No. - 2025:AHC:40560 Court No. - 44 Case :- WRIT - C No. - 4392 of 2025 Petitioner :- Santosh Kumar Jalothariya Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Virendra Singh Patel Counsel for Respondent :- C.S.C.,Deepak Gaur Hon'ble Kshitij Shailendra,J.
1. Having heard learned counsel for the petitioner, this Court finds that no property of the petitioner is involved in the matter and the
order impugned dated 22.11.2024 has been passed in purported exercise of powers under Section 77(2) of the U.P. Revenue Code, 2006 read with the powers conferred by Government Order dated
29.06.2021.
2. Learned counsel for the petitioner submits that change of class would affect the villagers and, therefore, the Court should entertain the petition.
3. Since this is not a public interest litigation for which certain legal requirements have to be fulfilled by the petitioner, this Court is not inclined to entertain a challenge to the order impugned in Writ-C.
4. The writ petition is, accordingly, dismissed with liberty to the petitioner to file a public interest litigation, if so advised.
