Present petition has been filed for the following relief: "(i) issue a writ, order or direction in the nature of Mandamus commanding opposite party No 3 to stopped the illegal constructions and remove the illegal encroachment of the said Gata No. 552 'measuring area 0.2020 Hectare recorded as talab' and gata no 550 'ka' measuring 0.0250 hectare which is recorded as 'Gram Vidyalaya' in a revenue record situated in Resident of Village Kodaila, Rampur Bhagan, Pargana Paschim Rath, Tahseel -Bikapur District- Ayodhya." 3. Learned Standing Counsel, based upon instructions, states that the proceedings under Section 67 of U.P. Revenue Code have been instituted. 4. Learned counsel for respondent no.6 states that his constructions were standing since long. 5. In view thereof, present petition is disposed off with direction to decide the pending proceedings under Section 67 in accordance with law. 6. Respondent Nos.5 & 6 would be entitled to take all the defenses that may be available under law which shall also be considered while deciding the proceedings under Section 67.
