By this application filed under Section 483 of the BNSS, 2023, the petitioners, namely, (1) Samsul Alom and (2) Joychan Ali have prayed for release on bail, who are in custody in connection with Gossaigaon P.S. Case No. 69/2025. The petitioners tried to steal crude oil from oil pipeline but they failed. Because of the act of the petitioners, there was fire in the pipeline due to leakage of crude oil and that was extinguished later. Earlier, this court rejected the bail prayer of the petitioners. The petitioners have submitted that they could not succeed in stealing crude oil. Moreover, they are in custody for more than 46 days. The case diary reveals that the Police have been investigating the case. I have considered the submission made by the learned counsel for both the sides. Considering the period of detention already undergone by the petitioners, this court is of the opinion that the prayer of the petitioners’ deserve to be accepted. Hence, the bail application of the petitioners is allowed. Accordingly, the petitioners, (1) Samsul Alom and (2) Joychan Ali, who are in custody in connection with Gossaigaon P.S. Case No. 69/2025, are allowed to go on bail of Rs.20,000/- each with one surety of like amount to the satisfaction of the learned SDJM (M), Gossaigaon. The bail application is disposed of.
