Lko. Counsel for Applicant :- Sandhya Devi Counsel for Opposite Party :- G.A. Hon'ble Subhash Vidyarthi,J.
1. Heard Ms. Sandhya Devi, learned counsel for the applicant, Shri Amit Kumar Dwivedi, the learned A.G.A. for the State and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No.80 of 2025 under Sections 419/420/467/468/506/471 I.P.C. registered at Police Station- Kotwali Dehat, District- Hardoi. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 28.02.2025 against the applicant and his mother Ram Devi stating that the applicant is son of Ram Devi and his first husband-Babu. The co-accused Ram Devi had separated from her first husband Babu, though there is no averment in the FIR that she had got her marriage dissolved by a decree of divorce and, thereafter, she married Chhote Lal. The informant Suman Devi is daughter of Ram Devi and Chhote Lal and they had two other children- a daughter- Baby and son Ratibhan. The accused persons got the informant's brother Ratibhan eliminated and the applicant has been convicted and sentenced with life imprisonment in the aforesaid case and he has been released on bail in Appeal. It is stated that in the educational documents and Aadhar Card of the applicant, his father's name is recorded as Babu but for grabbing the property
of the informant's father Chhote Lal, the informant got forged documents of identity prepared wrongly showing the name of his father as Chhote Lal and co-accused Ram Devi wrongly got her name mutated in respect of the properties of Chhote Lal and thereafter, she executed a registered gift deed in favour of the applicant on 06.03.2024. The FIR states that the informant has already filed a Suit No.1854 of 2024 for cancellation of the gift deed on 28.10.2024. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent and he has been falsely implicated in the present case. 5. Besides Criminal Case No.186 of 2002 under Section 302 I.P.C. referred in the FIR, the applicant is not involved in any other criminal case. 6.
The applicant's mother co-accused Ram Devi has already been granted bail in the present case by the Session Court. 7. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the grievance in the FIR is against the registered gift deed executed by co-accused Ram Devi and Ram Devi has already been granted bail by the Session Court and that the informant has already filed a suit for cancellation of the gift deed, I am of the view that the aforesaid
facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid case.
8. Accordingly, this bail application stands allowed.
9. Let the applicant- Rukumlal be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence;
(ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court. . [Subhash Vidyarthi, J.]
