Heard, learned counsel for the petitioners and learned counsel for the State. 2. The present anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanha, has been preferred by the petitioners apprehending their arrest for the offences registered under Section 406/420/467/468 and 471 of IPC. 3. It is alleged that petitioner Nos.2 and 3 had given power of attorney to one Habibullah Ansari for selling the land. Habibullah Ansari executed an agreement with the informant and had taken sufficient money and transferred the land to the informant. When the informant went to the land, it is alleged that he came to know that the land was earlier sold to someone else and they have been cheated. 4. After going through the documents, I find that the allegation against petitioner Nos. 2 and 3 is that they have executed power of attorney on behalf of petitioner No.1-Habibullah Ansari. The entire negotiations were done by Habibullah Ansari. 5. So far as petitioner No.1 is concerned, there is no sufficient material. 6. Considering the aforesaid materials and as petitioner No.2
(Babujan Ansari) and petitioner No.3 (Sakila Bibi @ Shakila Bibi) were the Principals, who executed the power of attorney in favour of the person who has negotiated with the informant, I am not inclined to grant anticipatory bail to them. 7. Further since, there are no sufficient material at this stage against petitioner No.1- Habibullah Ansari, I am inclined to allow his anticipatory bail. 8.
The petitioner No.1- Alauddin Ansari is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Court of Additional Chief Judicial Magistrate, Bermo at Tenughat, in connection with Jaridih Police Station Case No.53 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 9.
