This writ petition has been filed under Article 227 of the Constitution of India, whereby he petitioner has sought a direction to trial court i.e., learned IVth Additional Civil Judge (S.D.), Dehradun, to expedite hearing of the Original Suit No.26 of 2020, Nayan Tara Sahgal Vs. Sanjeev Thapliyal & others. 3. It is contended by learned counsel for the petitioner that the original suit is pending since 2020. He further submitted that the petitioner is aged about 97 years and she wants the matter to be decided during her lifetime. 4. It is contended by learned counsel for the petitioner that for one reason and the other the respondents are taking adjournment in the matter unnecessarily regarding the point of jurisdiction i.e., Issue no.7 which was decided in favour of the petitioner. The petitioner has annexed the entire order sheet till 06.10.2025 to justify his submissions made before this Court. 5. From perusal of the order sheet, it transpires that till 06.10.2025 even the plaintiff’s evidence has yet not been started. 6. In such view of the matter, it would be a futile exercise to give a direction to learned IVth Additional Civil Judge (S.D.), Dehradun, to decide Original Suit No.26 of 2020, Nayan Tara Sahgal Vs. Sanjeev Thapliyal & others, expeditiously at this stage. 7. Accordingly writ petition stands dismissed. (Pankaj Purohit, J.) 04.12.2025 SK
