SRAVAN KUMAR MANNAVA The Court made the following: ORDER: Heard Sri Pappu Srinivasa Rao, learned counsel for the petitioner and Sri Sravan Kumar Mannava, learned counsel for the respondent. 2. The present Civil Revision Petition is filed against the Order dated 10.03.2025 in I.A.No.124 of 2024 in H.M.O.P.No.134 of 2019, on the file of the Civil Judge (Senior Division), Amalapuram. The petitioner herein filed the said I.A., seeking for clubbing of H.M.O.P.No.10 of 2024 with H.M.O.P.No.134 of 2019 and for a consequential direction to record evidence in H.M.O.P.No.134 of 2019 and to pass appropriate orders. The said application is resisted by the respondent herein by filing a counter affidavit, interalia contending that if a joint trial is conducted, delay would be caused and in fact the Hon’ble Supreme Court vide Order dated 11.12.2023 in Transfer Petition (Civil) No.1475 of 2023, directed the expeditious disposal of H.M.O.P.No.167 of 2021, which is re-numbered as H.M.O.P.No.10 of 2024 on transfer to the Court of Civil Judge (Senior Division), Amalapuram. 3. Though the learned counsel appearing on both sides sought to advance detailed arguments, from the reading of the impugned order and it is also not in dispute that in H.M.O.P.No.10 of 2024, the affidavit of P.W.1 in lieu of chief- examination has already been filed, whereas in H.M.O.P.No.134 of 2019, the affidavits in lieu of chief examination are yet to be filed. 4. Be that as it may, as both the O.P’s are between the same parties and there is a direction by the Hon’ble Supreme Court in the abovementioned Transfer Petition for expeditious disposal of H.M.O.P.No.10 of 2024, wherein, undisputedly, the evidence is being recorded, this Court instead of going into the merits of the matter, to avoid conflicting decisions deems it appropriate to dispose of the civil revision petition with a direction to club both the O.P’s and with a further direction that the evidence shall be recorded in H.M.O.P.No.10 of 2024. Both the parties shall cooperate for the early disposal of the matters. 5. With the above direction, the Civil Revision Petition is disposed of. No order as to costs.
