Julius Riamei, learned counsel appearing for the respondent. [2] The present application has been filed under section 21(5) of the NIA Act, 2008 praying for condoning the delay of 234 days in filing the connected criminal appeal. [3] At the outset, Mr. D. Julius Riamei, learned counsel appearing for the respondent fairly submitted that the present condonation application may be allowed subject to payment of costs and the connected appeal be heard on merit. According to us, this submission made by the learned counsel is very fair and in the interest of justice. [5] Taken into consideration the submissions advanced by the parties, we are of the considered view that it will be in the interest of justice to heard on merit the connected appeal by condoning the delay as prayed for in the present application. Accordingly, the present application is allowed subject to payment cost of Rs. 5000/- only to be paid by the applicant in favour of the High Court Bar Association, Manipur.
