The instant application has been preferred for the following main relief:- "WHEREFORE, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to direct to Learned Additional Court no. 7, Lucknow to decide complaint case no. 75668/2021 Under section 138 of Nogotiable Instrument Act Police Station Ashiyana, District Lucknow within stipulated period as fixed by this Hon'ble Court. It is further prayed that this Hon'ble Court may further be pleased to direct Learned Additional Court no. 7, Lucknow to issue Non bailable warrant against the opposite party no. 2 in the above noted case." Considering the facts and circumstances of the case as also that the complaint case in issue is pending consideration since 2021 before the trial court concerned and as per Section 143 of the Negotiable Instruments Act, 1881, case instituted under Section 138 of the Act of 1881 shall be concluded expeditiously as possible and an endeavour shall be made to conclude the trial within six months from the date of filing of the complaint, the present application is disposed of with a direction to the court concerned to decide the case in issue, expeditiously.
