Learned State counsel at the very outset has raised a preliminary objection regarding maintainability of this petition in view of the fact that opposite party no.5, Shilpi Devi wife of Rajendra Kumar has already been selected and appointed on the said post but the selection has not been challenged. 4. Considering aforesaid facts and circumstances, petition is dismissed as withdrawn granting liberty to petitioner to file afresh in case so advise with the proper grounds and prayers.
