1. Heard learned counsel for petitioner, learned Standing Counsel, who appears for State respondents.
2. This petition has been preferred with the following main prayers:-
"Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to: -
1. Issue a writ order or direction in the nature of mandamus commanding the opposite parties to look into the matter and also ensure the repairing work of broken door of petitioner's house situated at Gata No. 594 Town Area Dostpur, Police Station - Dostpur, District - Sultanpur (Annexure No. 6 to the writ petition) in the interest of justice.
"
3. It has been submitted by learned counsel for the petitioner that house in dispute has been constructed over gata no. 594 and the opposite party nos. 6 to 9, who are inimical to the petitioner, have forcibly broken the eastern door of the petitioner's house. The petitioner has tried to reconstruct the same, but the respondent nos. 6 to 9 have muscle power and are politically well connected, therefore, the petitioner has been unable to construct the eastern door of his house and therefore, this writ petition has been filed.
4. Learned counsel for the petitioner has also submitted before this court that the petitioner has made a representation in this regard to the S.D.M, Kadipur and to the District Magistrate, but the District Magistrate, in turn, asked the report from the S.D.M Kadipur. The S.D.M Kadipur has sent a report which is favourable to the petitioner, yet, the police are not helping the petitioner because earlier, the police station was constructed on the land of the petitioner and he was not able to get an order of eviction of the police station from his bhumidhari land. The police are also inimical to the petitioner.
5. The dispute is purely private in nature.
6. The present writ petition is dismissed. Order Date :- 11.8.2025 DiVYa Digitally signed by :- DIVYA SINGH High Court of Judicature at Allahabad, Lucknow Bench
