The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 395, 397 and 412 of the Indian Penal Code and Sections 25(1b)(a), 26, 27 and 35 of the Arms Act, 1959. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on the basis of confessional statement made by the co-accused persons. Further submission has been made that neither any pistol nor any live cartridges were recovered from the possession of the petititioner. Further, the co-accused persons, namely, Mahendra Choudhary in B.A. No. 10104 of 2022, Raj Kumar Choudhary in B.A. No. 10130, Gulab Paswan @ Guddu @ Guddu Paswan in B.A. No. 12745 of 2022, Bibhash Paswan @ Mrigendra Paswan in B.A. No. 12927 of 2022, Santosh Vishwakarma @ Santosh Kumar Vishwakarma in B.A. No. 12083 of 2022 and Ritik Roshan @ Ritik Raushan in B.A. No. 1238 of 2023 vide orders dated 08.12.2022, 19.12.2022, 16.01.2023, 25.01.2023, 01.03.2023 and 13.03.2023, respectively, have been granted bail by the Co-ordinate Bench of this Court. Further, the petitioner has been languishing in custody since 31.07.2024 2025:JHHC:14627 ) 2 4. Learned APP opposed the prayer for bail. 5. Having regard to the facts of the case and looking to the allegations made against this petitioner, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing the bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II, Bokaro in connection with Sector- 4 P.S. Case No. 50 of 2022(S). 6. It is made clear that till commencement of trial, the petitioner shall report to the local police station every month and after commencement of trial, he shall appear on each and every date before the learned trial court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this petitioner, the learned trial court shall be at liberty to cancel the bail of this petitioner.
