By means of this instant petition preferred under Article 227 of the Constitution of India, the petitioner seeks expeditious disposal of an application preferred under Order 9 Rule 9 C.P.C. 3. The record indicates that the suit of the plaintiff was dismissed for want of prosecution on 21.1.2025 whereafter the application for recall has been moved. The record further indicates that the matter is listed before the court concerned on 8.8.2025. 4. Considering the aforesaid submissions, this Court is not inclined to pass any order leaving it open for the petitioner to move appropriate application before the court concerned who needless to say shall consider the said application and pass appropriate order in accordance with law 5.
