FIR in Cr.No.4/25 of Gudibande Police Station, Chikkaballapura, is registered against accused Nos.1 and 2 for the offence punishable under Section 61(2), 109 r/w 3(5) of BNS, 2023. 3. This petition is preferred under Section 483 of BNSS, 2023, praying to enlarge the petitioners on bail. 4. In brief, the case of prosecution is that the complainant and his brother are having 03 acres of land in Sy.No.25/1B of Pulasanivoddu village, Gudibande Taluk. Accused No.1 is also having landed property adjacent to the said land. There was some dispute between the - 3 - NC: 2025:KHC:5278 CRL.P No. 1388 of 2025 accused and his brother Adinarayana Reddy in relation to the said property and in view of the same, they were quarrelling with each other. Complainant had advised the accused not to quarrel. Hence, there was enmity. It is alleged that, the accused gave electricity connection to the iron gate situated in front of his land by drawing electricity from the nearby electric pole situated in the land of one Babulal with an intention to take away the life of complainant. On 17.1.2025, at about 8.00 pm, when the complainant returned to his house and tried to open the gate, he suffered electric shock and sustained injuries to his right hand. 5. According to complaint averments, these petitioners have drawn the electricity from the nearby pole and gave electricity connection to the iron gate, so that, the complainant coming in contact with the electricity drawn to the iron gate, would die of electrocution. 6. Complainant is suspecting the petitioners, as he had advised them not to quarrel with the brother of - 4 - NC: 2025:KHC:5278 CRL.P No. 1388 of 2025 accused No.1. It is alleged, the said accused were nurturing ill-will against him. At this stage, there are no other material placed on record to show that it was these petitioners who have drawn the electricity connection to the iron gate, with an intention to electrocute the complainant. 7. Petitioners are arrested and interrogated and they are in judicial custody from 18.1.2025. Considering the facts and circumstances, by imposing suitable conditions, relief sought by them can be granted. Hence, the following: ORDER 1. Petition is allowed. 2. Petitioners/accused Nos.1 and 2 in Crime No.4/2025 of Gudibande Police Station shall be enlarged on bail, subject to following conditions: 1. They shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) each, with two sureties for - 5 - NC: 2025:KHC:5278 CRL.P No. 1388 of 2025 the likesum to the satisfaction of the jurisdictional Court. 2. They shall furnish proof of their residential address and shall inform the I.O. / Court, if there is change in the address. 3. They shall not directly or indirectly tamper with the prosecution witnesses. 4. They shall not indulge themselves in committing any offence. 5. They shall appear before the trial Court regularly on all dates of hearing. Violation of any of the condition shall result in cancellation of bail.
