Kalita, the learned counsel appearing on behalf of the petitioners. Mr. C. Baruah, the learned counsel appears on behalf of the respondent No.2 and Mr. J. Handique, the learned counsel appears on behalf of the respondent Nos.3, 4 & 5. 2. The petitioners herein are aggrieved by the illegal construction carried out by the private respondents in as much as the petitioners apprehends that such illegal construction so carried out is unsafe religious construction and is dangerous for human life and property. 3. This Court during the course of hearing enquired with Mr. D. Kalita, the learned counsel appearing on behalf of the petitioners as to whether the alleged illegal construction is over the land belonging to the petitioners. The learned counsel for the petitioners with all fairness submitted that the construction is being carried out in Government land. 4. Taking into account the above, this Court finds that there is no locus standi of the petitioners to approach this Court. Page No.# 5/5 5. Accordingly, the instant writ petition stands dismissed. 6. Be that as it may, this Court however observes that dismissal of the writ petition shall not however affect the rights of the National Highways Authority of India as well as the State Government to take action against the private respondents, if so permissible under law. 7.
