1. Mr. Abhishek Verma, learned counsel for the petitioner.

4. The petitioner, Mr. Arun Kumar Singh is praying for quashing of FIR dated 10.02.026, bearing FIR NO. 0047 of 2026, lodged by respondent no. 3 implicating the petitioner under Section 115 (2), 352, 351(3), 64(1) and 331(2) BNS 2023 at P.S. Kashipur District U.S. Nagar.

There is no dispute the petitioner married with the complainant in June 2025 which is evident from the photographs which is enclosed in the short counter affidavit filed by respondent/ complainant as annexure 6 and this fact is also admitted by the petitioner that he married with the respondent/complainant in June 2025. Thereafter some differences were arose and both of them caused injury to each other, as submitted by the learned counsel for the parties. Consequently, the respondent/complainant lodged the impugned FIR.
6. In the counter affidavit it is contended that both of them living
separately since almost from 5 to 6 months. Certain whatsapp messages and photographs on the social platform which was uploaded by the complainant has been deleted by herself by saying sorry and now chapter is now closed.

Learned counsel for the parties also apprise to this Court that no litigation either under the Domestic Violence Act or Hindu Marriage Act or to seek divorce has been instituted by either of the parties, meaning thereby they both are wife and husband even as on date. Taking into consideration that both the petitioner and complainant/respondent married with each other, as admitted by them, in June 2025, this Court is of the view that there should be an amicable settlement in between both the parties either they may live together or get separation forever and this requires proper counseling.

In such view of the matter, the matter is being posted on 10.03.2026 and on that day both the parties shall appears before the Counsellor at 11:00 am and then matter be again placed before this Court at 4:00 pm. During this period both the parties are directed not to make any complaint against each other and if they have any grievance with each other they immediately approach to the concerned S.H.O. and the concerned S.H.O. shall redress their grievance either by calling both of them or calling separately. Both the parties are
directed not to send any message on social media platform. Since, petitioner is married person, he is also directed not to make any attempt either to engage with another lady or to get remarry until and unless divorce decree is passed and he
has to comply the direction in strict sense. Apart from this neither the petitioner will visit to the house of the respondent/complainant nor respondent/ complainant make any attempt to approach his superiors where petitioner is serving.
9. Till the next date of listing the investigation may go on, however, no coercive action shall be taken against the petitioner provided he cooperates with the investigation.
