The petitioner apprehending his arrest for the offences punishable under Sections 414/34 of the IPC, under Sections 4/21 of the MMDR Act and Sections 9,13 of the JMPIMTS Rule, has prayed for grant of anticipatory bail, in connection with Govindpur PS Case No. 173 of 2023.

Learned counsel for the petitioner submits that the petitioner has committed no offence and he has falsely been implicated in this case. It has been submitted that the petitioner has authority and license to store and sell the coal in the coal depot because of having GSTIN number. He submits that there is no theft report regarding seized coal rather the alleged rest seized coal is purchased property of the petitioner. Hence, the petitioner may be enlarged on anticipatory bail.

Learned Spl. PP opposes the prayer for grant of anticipatory bail to the petitioner.

Having regard to the facts of the case coupled with the fact that though there are three criminal antecedents against this petitioner however in all these cases the petitioner has been acquitted, I am inclined to enlarge the petitioner on anticipatory bail and accordingly,

the petitioner, above-named, in the event of his arrest or surrender before the Court below within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad, in connection with Govindpur PS Case No. 173 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita,
