Heard learned counsel for the parties.
2. Petitioners are apprehending their arrest in connection with Kunda P.S. Case No. 65/2025 for the offence registered under Sections 317(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023 and under Section 4 and 54 of J.M.M.C. Rules, 2004 and Section 4 and 21 of MMDR Act and Section 15 of Environment Protection Act, 1986.
3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He further submits that the petitioners have got no concern with the seized sand and there is no criminal antecedent against them, as such they may be given the privilege of anticipatory bail.
4. Learned A.P.P. opposed the prayer for anticipatory bail.
5. Having regard to the facts of the case and looking to the allegation made against these petitioners, I am inclined to enlarge the petitioners on anticipatory bail. Accordingly, the petitioners are directed to surrender before the court below within a period of four weeks from today and the learned court below on his surrender shall release them on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Deoghar in connection with Kunda P.S. Case No. 65/2025, subject to the conditions as laid down under Section 482(2) of BNSS, 2023.
6. It is made clear that if the petitioner will not cooperate in investigation/trial, the State would be at liberty to take appropriate action.
