Neutral Citation No. - 2025:AHC-LKO:47328 Court No. - 6 Case :- WRIT - C No. - 7615 of 2025 Petitioner :- Md.Raeesh Respondent :- Deputy Commissioner Food And Civil Supply Devipatan Mandal Gonda And 2 Others Counsel for Petitioner :- Rakesh Pathak,Vijay Pathak Counsel for Respondent :- C.S.C. Hon'ble Pankaj Bhatia,J.
1. Heard the counsel for the petitioner and the learned Standing Counsel.
2. The present petition has been filed by the petitioner challenging an order dated 19.04.2025 whereby the appeal preferred by the petitioner has been rejected.
3. The facts, in brief, are that the original allottee of the fair price shop, had approached the appellate forum against an order cancelling his shop, which resulted in the matter being remanded. On the remand, an order dated 25.10.2024 came to be passed in favour of the original allottee of the shop in question. The petitioner prays that during the process of remand, the proceedings were taken for fresh allotment and in the meeting held, the petitioner had secured highest votes, however, it is admitted that no order of allotment was passed and the elections held were not approved by the Tehsil Level Committee.
4. The petitioner challenged the order dated 25.10.2024 whereby the shop in question was allotted in favour of the original allottee in pursuance to the order passed after the remand of the proceedings. Clearly the petitioner is not an aggrieved person who could prefer the appeal. The appeal in question has been dismissed on that ground also.
5. In view of the fact that the petitioner is not an aggrieved person against an order dated 25.10.2024, the appeal at his instance was not maintainable and was rightly dismissed.
6. No good ground for interference is made out. The petition is dismissed. Order Date :- 13.8.2025 VNP/- Digitally signed by :- VISHVANATH PRASAD SHUKLA High Court of Judicature at Allahabad, Lucknow Bench
