Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondent to pay the petitioner interest at the rate of 18 percentage per annum, for the period of delay from 01.06.2019 to 24.01.2021, in paying the amounts paid towards his terminal benefits namely EPF Employee's Contribution, Gratuity and Encashment of leaves within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits. ORDER The instant writ petition has been filed by a retired employee of the respondent Transport Corporation, seeking a mandamus directing the respondent to pay interest for the belated payment of petitioner’s terminal benefits.
2. According to the learned Counsel appearing for the writ petitioner, the petitioner was appointed in the respondent Transport Corporation on 27.06.1987, and he had attained superannuation on
31.05.2019. The terminal benefits were disbursed belatedly to the writ petitioner only on 25.01.2021. Hence, he sent a representation on 02.06.2025 seeking interest for the belated payment. Since, there is no response from the respondents authorities, the present writ petition has been filed.
3. Considering the above said facts, the respondent Transport Corporation is directed to pay interest at the rate of 6% from the due date till the date of disbursement within a period of twelve (12) weeks from the date of receipt of a receipt of a copy of this order. 2/4 https://www.mhc.tn.gov.in/judis
