Neutral Citation No. - 2025:AHC-LKO:44932 Court No. - 8 Case :- WRIT - A No. - 8624 of 2025 Petitioner :- Munni Prabha (S.I. Pno-942320020) Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Home Lko. And 5 Others Counsel for Petitioner :- M.P. Raju Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. 1. Heard learned counsel for petitioner and learned State Counsel appearing on behalf of the opposite parties. 2. Petition has been filed challenging order dated 14.06.2025 whereby petitioner currently employed on a Class-III post has been transferred. Also under challenge is the order dated 15.07.2025 whereby her representation has been rejected. 3. It has been submitted that despite the fact that petitioner has less than two years of service left, she has been transferred in violation of Paragraph-5 (v) of the Government Order dated 06.05.2025. He has further submitted that opposite parties have also not taken into consideration the fact that petitioner's daughter is currently studying Law in Lucknow. 4. Ms Deep Shiksha, learned Chief Standing Counsel has refuted submissions advanced by learned counsel for petitioner with the submission that impugned order clearly indicates the fact that petitioner has been continuously posted in district Lucknow for the past more than 15 years and therefore requires to be transferred. It has further been submitted that since petitioner belongs to Class-III category and Lucknow not being her home district, such consideration cannot be made. 5. Upon consideration of submissions advanced by learned counsel for parties and perusal of material on record, it is evident that petitioner admittedly has spent more than 15 years in district Lucknow. In terms of Paragraph-5 (v) of the Government Order dated 06.05.2025, all such Class-III employees who have less than two years to superannuate, are required to be posted in home district. It is not the case of petitioner that Lucknow is her home district and therefore, aforesaid Paragraph-5 (v) of the Government Order dated 06.05.2025 would be inapplicable upon petitioner. 6. There is no other ground indicated which would confer any vested right upon petitioner to continue in Lucknow district. 7. In view of aforesaid, the petition fails and is dismissed at the admission stage. Parties to bear their own costs.
